This website is operated by NXT Football.  Throughout the site, the terms “we”, “us”, “our” refer to NXT Football. NXT Football offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”,” Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered and offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Medical

If you know about or are concerned that that you or your child may have a medical condition which might interfere with undertaking activity safely you should seek advice from a relevant medical professional and follow that advice.
You should not undertake activity that is beyond your own ability, or you having been told are not suitable.

Be aware that sporting activity carries a risk of injury. Activity is completely voluntary; by participating you accept the risk normally associated with sporting activity.
In the event of illness or injury at an NXT Football program (or associated event or program), you hereby grant NXT Football staff and/or representatives' full consent to administer medical treatment and/or take appropriate action to call on appropriate medical professionals (including ambulances if required) at your own cost.

Activity

NXT Football programs involve physical activity which carries inherent risk. By enrolling, participants confirm they are medically fit to participate and do so at their own risk. NXT Football accepts no liability for injury, illness, or other damages incurred during sessions, except as required under Australian Consumer Law.

Parents must ensure that appropriate attire is worn for the duration of the program. This includes, but not limited to:
Football boots (no metal studs), Shinpads, Mouthguard (if applicable), Headgear (if applicable)

Photography and Videography

NXT Football and its sponsors may take photographs and videos of players and distribute these on social channels, marketing campaigns and promotional materials.

If you or your child do not consent, please confirm same in writing. Please email us at nxtfootballau@gmail.com before the commencement of each individual booking to ensure this will be actioned. While we will take reasonable steps to exclude those participants, we still cannot guarantee this participant will not be featured in marketing material.

Invoices

NXT Football will invoice the Client before the commencement of the program, unless otherwise notified by the Client regarding payment schedules. The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension, termination from NXT Football and/or attract an administration fee until the balance is paid in full.

Payment methods

Payment will be made to the Business via cash, cheque, an approved payment card, or by any other payment method that is accepted by the Business.

Consumer Guarantees

(a) Nothing in this Agreement is intended to exclude, restrict or modify the rights which either of the parties may have under the Australian Consumer Law. (b) A failure to comply with the Consumer Guarantee provisions under the Australian Consumer Law to the extent they apply to this Agreement, the Business’ liability is limited to (at its election):

(i) in the case of a supply of goods: (A) replacing the goods or supplying equivalent goods; (B) repairing the goods; (C) paying the cost of replacing the goods or acquiring equivalent goods; or (D) paying the cost of having the goods repaired; and
(ii) in the case of a supply of services: (A) resupplying the services or (B) paying the cost of having the services supplied again.

Cancellation of sessions

Scheduled sessions may be cancelled by NXT Football due to inclement weather, which is permissible on shorter notice though will be discussed between both parties as soon as inclement weather arises. Rescheduling of cancellations will be made following the completion of the programs with a date advised by NXT Football. NXT Football reserves all rights to reschedule and/or change venues for any reason. This will not be considered a cancellation.

Each child is limited to ONE make-up session per term.

If you are away for more than one session, you will still be charged for the session and not be given a second make-up session.

Refunds

NXT Football commits to doing everything possible to deliver all program hours and deliverables for every individual program. But will not be held liable to refunds or credits should it not be possible to deliver any component of the program for reasons out of our control.

Refunds are not provided for any/all classes.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless NXT Football, its staff, and affiliates against any claims, liabilities, damages, losses or expenses arising out of or in connection with your or your child’s participation in any program or use of our services, facilities or equipment.

Consent

By enrolling in the NXT Football program, participants understand that they are attending the programs and using the facilities at their own risk. In addition, its owners, employees or agents, shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by participant with his/her family in or about any programs on the premises. 

By enrolling your child or participating in an NXT Football program, you acknowledge and agree that participation in sports and physical activity carries inherent risks of injury or illness, including but not limited to sprains, fractures, concussions, or other bodily harm.

You voluntarily assume all risks, both known and unknown, even if arising from the negligence of NXT Football or its staff, and agree to release, discharge, and hold harmless NXT Football, its officers, employees, contractors, and volunteers from any liability, claims, demands, or causes of action that may arise from participation in our programs. This waiver applies to injuries, damages, or losses occurring on-site or during program-related activities off-site.

Further, participants and parents assume full responsibility for all injuries and damages which occur in or about any programs on the premises. He/she does hereby fully and forever release discharged hold harmless, all associated facilities and its owner, employees, and agents from all claims, demands, damages or rights of action, present or future resulting from any person’s participation in any programs or use of the facility.

Consent: The Guardian/participant or I, the undersigned parent, does hereby grant authority to the staff at NXT Football to render a judgment concerning medical assistance or hospital care in the event of an accident or illness during my absence, at my expense. This includes calling for an ambulance, first aid, or hospitalisation where required. You agree to indemnify NXT Football and its staff for any costs incurred in doing so.

I do hereby authorize NXT Football to utilize all photographs, pictures or other likeness of anyone or me assigned guardianship to me, as they deem appropriate in its promotional materials or team films.
